Terms of use

The short version: JuaPass is an independent directory of hotel day passes, compiled from sources open to anyone and from what hotels tell us. We take real care to get it right and we date every listing, but we do not sell the passes and we cannot guarantee a hotel’s terms on the day you arrive. If you are a hotel and something here is wrong, or you would rather it were not shown, tell us — we act on that.

What this site is

JuaPass is an independent directory of day access to hotel facilities — a pool, a beach club, a spa — published as an information service. We are not a travel agent, a booking agent, a reseller or an intermediary, and we are not an agent of any hotel listed here.

We do not sell day passes, take bookings, hold payments or charge a commission. Every listing links to the hotel, and anything you buy is bought from the hotel on the hotel’s own terms, at the hotel’s own price. That contract is between you and the hotel; we are not a party to it, and we take no responsibility for how it is performed. Questions about a booking, a refund or the facilities themselves are for the hotel.

Where the information comes from

A listing is assembled from information that is already available to anyone who looks: a hotel’s own website and its published pages, public business and mapping listings, published rates and facility pages, and public accounts and reports from people who have visited. Where we can, we also write to the hotel and ask it directly, and where a hotel answers, its answer is what we publish.

We publish this as factual business information about a service offered to the public. Listings are compiled and published on our own initiative and are not authorised, endorsed, sponsored or reviewed by the hotels described, and we do not represent otherwise. Nothing on this site should be read as a statement that a hotel is affiliated with us, is a partner or advertiser, or has approved what appears about it. Where a hotel has confirmed its terms to us, the listing says so and gives the date.

Hotel names, marks and logos belong to their owners and are used here only to identify the property a listing describes. Photographs are shown from the hotel’s own published pages or from the mapping services we draw on, with the attribution those services require; we do not claim ownership of them, and a picture is removed on request from whoever holds the rights in it.

How accurate this is, and what that means

We make genuine efforts to publish only what a source actually stated, to record nothing we have inferred or assumed, to date every listing with the day we last checked it, and to check again periodically. Where our confidence in a detail is low, it goes to a person before it is published rather than straight onto the site.

Even so, this is a directory of arrangements that change without notice. Prices move, hours change seasonally, a pool closes for refurbishment and a hotel withdraws day access without telling anyone — usually before our next check. So the site and everything on it is provided on an “as is” and “as available” basis, and to the fullest extent the law allows we give no warranty, express or implied, that any listing is accurate, complete, current or fit for a particular purpose, or that the site will be uninterrupted or error-free.

Please treat a listing as a starting point rather than a promise: confirm the price, the times and what is included with the hotel before you travel or spend money on the strength of it. Nothing here is advice, an offer, or a guarantee of availability.

If you are the hotel

We would far rather a listing were right than merely defensible. If something about your property is wrong, out of date, or no longer offered, tell us and we will correct or remove it — the form on your listing reaches us, and so does a reply to any email you have had from us. A message from the property itself is acted on quickly, and we do not need a legal reason to act on it.

We also recognise that some hotels sell day access but would rather it were not advertised. We can hold a listing behind our members area, where it is visible only to signed-in members and is left out of the public site and out of search engines, instead of removing it altogether. If that suits you better than a takedown, ask for it.

More generally, we decide what appears here. We may publish, decline to publish, amend, hide, restrict to members or remove any listing at any time, at our discretion and without giving reasons. Being listed is not a service we owe anyone and does not create any agreement, partnership or obligation between us and a hotel; equally, nothing in these terms obliges us to keep a listing up.

Reports from readers

Anyone can tell us a listing looks wrong, and we read every report. A report is information for us to check, not an instruction to the site: nothing is unpublished or altered on a message alone, and where a report concerns a hotel’s own terms we go back to the hotel before changing anything. A form that could take a listing down would be a form anyone could point at a competitor.

When you send us a report, please send only what you are entitled to send and believe to be true, and do not treat it as confidential. It is used to check and improve the listing.

Using the site

You are welcome to read, search and link to anything here. Please do not scrape, harvest or systematically copy the listings, or reproduce the directory or a substantial part of it elsewhere; the compilation, the site’s text, design and code are ours and are protected accordingly. Please also do not use the site unlawfully, interfere with its operation, or misuse the contact details published on it.

The members area is offered on the same terms as the rest of the site, with one addition: the listings in it are shown to members because the hotel asked that they not be advertised, so please keep them to yourself rather than republishing them. Accounts may be suspended where that is not respected.

Links out to hotels and to other sites are provided for convenience. We do not control those sites and are not responsible for their content, their terms or what they do with your data.

Liability

To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of this site or your reliance on anything published here — including a price or a time that has changed, a pass a hotel has withdrawn, a listing that is incomplete, or a dealing between you and a hotel. Our aggregate liability arising out of the site is limited to the amount you have paid us, which for a visitor is nothing.

Nothing in these terms limits any liability that cannot lawfully be limited, including for fraud, for fraudulent misrepresentation, or for death or personal injury caused by negligence. If any part of these terms is found unenforceable, the rest continues to apply.

Changes, and the law that applies

We may update these terms as the site changes. The date at the top says when they were last revised, and the version published here is the one that applies to your use of the site.

These terms, and any dispute about them or about the site, are governed by the laws of Tanzania. How we handle personal information is described separately in our privacy policy.

Getting in touch

The quickest route is the “tell us about this listing” form at the foot of the listing itself, which names the property for us. If you have had an email from us, replying to it reaches the same people — every address we write from is one a person reads, and we answer.
